The United States Supreme Court has declined to block the state of Alabama from executing a convicted murderer by suffocating him with nitrogen gas.

Kenneth Smith is scheduled to be put to death using the untested method on Thursday.

The Supreme Court issued a two-sentence long statement saying it rejected Kenneth Smith's petition to review the case.

There is still one legal avenue yet to be exhausted, but as it stands, Smith will be killed on Thursday night by having an airtight mask strapped to his face and being forced to breathe pure nitrogen, which will starve his body of oxygen.

The UN has already urged a stay of execution saying the new procedure could amount to torture.
